Alien App Terms of Use

These Terms of Use explain how the Alien App works and what you agree to when using it. The App is a multi-chain self-custodial wallet that connects verified users through biometric verification on the Alien network. Currently, the App supports the Alien blockchain and Solana blockchain.
IMPORTANT: SECTION 16 CONTAINS MANDATORY ARBITRATION AND CLASS ACTION WAIVER PROVISIONS THAT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS. PLEASE REVIEW THIS SECTION CAREFULLY.
1. Agreement to Terms
By using the App, you agree to these Terms and our Privacy Policy. If you don't agree with these Terms, please don't use the App and uninstall it from your device.
2. Privacy and Data Protection
Your personal information, including biometric data, is handled according to our Privacy Policy. Using the App means you accept how your data is collected and protected as described in that policy. The Privacy Policy is incorporated into these Terms by reference.
3. Modifications to Terms
Alien may update these Terms from time to time. When changes are made, the "Last Updated" date and version number at the top of this document will be updated. Changes take effect as soon as they're posted, unless otherwise specified. Changes won't apply retroactively to disputes that arose before the modification date. However, dispute resolution modifications (Section 16) apply only to claims arising after the change. You're responsible for checking these Terms periodically. Continued use of the App after modifications means you accept the revised Terms. Provisions intended to survive termination will remain valid after your account closure.
4. Eligibility Requirements
You confirm that you meet all of the following requirements each time you use the App:
You have reached the age of majority in your jurisdiction and possess the legal capacity to enter into binding contracts
You are not located in, nor are you a citizen, resident, or agent of Afghanistan, Cuba, Iran, North Korea, Sudan, Syria, or Russia (including Crimea, Donetsk, and Luhansk regions of Ukraine) (collectively, "Prohibited Jurisdictions")
You do not appear on any sanctions list maintained by the United States, United Nations, European Union, or United Kingdom
You have not received assets from, and do not control blockchain addresses associated with, any sanctioned individuals or entities
You will not engage in transactions involving Prohibited Jurisdictions or sanctioned parties
You will maintain only one account registered under your authentic legal name
Alien has not previously restricted or terminated your access
You are not providing false information or registering on behalf of another party
Failure to meet these eligibility requirements prohibits your use of the App. Circumventing restrictions through VPNs, proxy servers, or similar tools is strictly forbidden and may result in legal consequences.
5. Account Creation and Biometric Verification
5.1 Registration Process
Using the App requires creating an account with biometric verification to confirm you're a unique person. You must provide accurate and current information when you sign up and keep your account information up to date.
5.2 Biometric Data Consent
Creating an account requires submitting biometric data, including facial images and video recordings, as detailed in our Privacy Policy. By creating an account, you explicitly consent to the collection and processing of this biometric information for uniqueness verification and, if you choose, for machine learning model improvement. You may withdraw your consent for data retention as specified in the Privacy Policy.
5.3 Verification Incentive
Alien may offer a one-time incentive upon successful account verification, which may take the form of Aliencoin (ALN) as disclosed during the registration process. Eligibility and conditions for any verification incentive will be clearly communicated during account creation. Alien reserves the right to modify or discontinue verification incentives at any time.
5.4 Account Security
Your account credentials are personal and non-transferable. You must not share access with others or allow unauthorized use of your account. Immediately notify us at support@alien.org of any suspected unauthorized access or security breach.
6. License Grant
Subject to your compliance with these Terms, Alien grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the App on devices you own or control. Alien retains complete ownership and control over the App. Alien may modify, suspend, or discontinue the App or any features without notice. Alien reserves the right to limit, suspend, or terminate your access at any time for any reason, including violation of these Terms. You acknowledge that App unavailability may occur and that Alien bears no liability for such interruptions.
Alien reserves the right to:
Take appropriate action, including account suspension or termination, in response to Terms violations
Fully cooperate with law enforcement or judicial orders requiring disclosure of user information or activities
7. Aliencoin and Digital Wallet
7.1 Aliencoin Overview
Aliencoin (ALN) is the native digital currency of the Alien network, distributed exclusively to verified, unique individuals, with no pre-mining, presales, team allocations, or investor privileges. This ensures equal treatment of all participants regardless of when they join the network.
ALN serves as a reward for uniqueness verification, provides network participation incentives, enables peer-to-peer transfers, facilitates transaction fee payments, and functions as the native exchange currency within the ecosystem.
ALN does not provide staking capabilities, governance rights, voting privileges, or any form of equity or ownership in Alien or its affiliates.
7.2 Digital Wallet
You will create a non-custodial digital wallet to receive and manage digital assets on supported blockchains. The App currently supports the Alien blockchain and Solana blockchain. "Non-custodial" means Alien does not control your wallet, hold your private keys, or facilitate transactions. You are solely responsible for:
Setting up and maintaining secure access to your wallet
Safeguarding your private keys and wallet credentials
All transactions to and from your wallet across all supported blockchains
CRITICAL: Alien cannot recover lost private keys or restore access to wallets. Loss, theft, or unauthorized access to your wallet or digital assets is entirely your responsibility. You waive all claims against Alien for any such losses, including but not limited to lost, stolen, or misappropriated digital assets.
7.3 Blockchain Transactions
Transactions are recorded on the respective blockchain infrastructure (Alien blockchain and Solana blockchain). The Alien App is not responsible for blockchain operations, third-party validators, or any losses resulting from blockchain interactions or third-party failures.
7.4 Free Transfers
The App provides a daily allocation of fee-free peer-to-peer ALN transfers between verified users. The number of free transfers and applicable limitations are displayed within the App.
8. Third-Party Services and Mini-Applications
The App may integrate third-party services, applications, or content ("Third-Party Services"). Alien does not control Third-Party Services and accepts no responsibility for their operation, content, or any resulting losses. Your interaction with Third-Party Services is governed by their respective terms and conditions and occurs entirely at your own risk.
9. Prohibited Conduct
You agree not to:
Violate any applicable laws, regulations, or government policies
Infringe intellectual property rights or other proprietary rights of Alien or third parties
Compromise the security of your wallet or others' digital assets
Impersonate any person, entity, or Alien representative
Transfer, sell, or trade ALN in violation of these Terms or applicable law
Engage in fraudulent, deceptive, threatening, harassing, defamatory, discriminatory, or otherwise harmful or illegal behavior
Access, copy, or store App source code
Create derivative works based on the App
Reverse engineer, decompile, or attempt to extract source code from the App
Gain unauthorized access to App systems, servers, or connected infrastructure
Circumvent, disable, or interfere with App security features or content protections
Launch denial-of-service attacks or similar network attacks
Use the App for fraudulent, deceptive, or manipulative purposes
Employ bots, automated systems, or scraping tools to access or copy App content
Introduce malicious code, including viruses, malware, or trojans
Overburden, damage, or impair App functionality
Restrict or interfere with other users' access to or enjoyment of the App
Otherwise interfere with proper App operation
10. Tax Obligations
You are solely responsible for determining and fulfilling all tax obligations related to your App usage, including taxes arising from digital asset acquisition, holding, transfer, or disposal. Alien does not provide tax advice. Consult qualified tax professionals regarding your specific tax situation.
11. Transaction Fees
Blockchain transactions may require payment of network fees (commonly called "gas fees"). These fees are determined by blockchain network conditions and are outside Alien's control. Fee amounts can fluctuate significantly and unpredictably.
12. Intellectual Property
12.1 Alien Ownership
Alien (or its licensors) owns all rights, title, and interest in the App, including all graphics, designs, systems, code, software, content, user interfaces, visual elements, and other materials (collectively, "Alien Property"). Your use of the App grants no ownership rights in Alien Property. All rights not explicitly granted are reserved by Alien.
12.2 User Feedback
If you submit ideas, suggestions, proposals, or other feedback regarding the App, you assign all rights in such feedback to Alien. Alien may use your feedback for any purpose without attribution or compensation, though Alien is not obligated to use any feedback provided.
13. Dispute Resolution, Arbitration, and Governing Law
These Terms are governed by Delaware law, excluding conflict of law principles. All disputes, claims, or controversies arising from these Terms or your use of the App ("Disputes") will be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will occur in Wilmington, Delaware before a single neutral arbitrator, conducted in English. All arbitrations proceed on an individual basis; class arbitration and class actions are prohibited. No arbitration may be consolidated with any other proceeding.
OPT-OUT RIGHT: You may opt out of these arbitration provisions by sending written notice to support@alien.org within thirty (30) days of your first use of the App.
Subject to the arbitration provisions, you and Alien consent to the exclusive jurisdiction and venue of federal or state courts in Wilmington, Delaware for any Disputes not subject to arbitration. Alien may seek injunctive relief for Terms violations in any competent court. The prevailing party in any dispute resolution proceeding shall recover reasonable legal fees and costs from the non-prevailing party.
14. Communications and Notice
All official communications must be in English and reasonably detailed. Notices become effective when delivered to the recipient's registered email address or published by Alien as described herein. Alien's official contact for all Terms-related notices is: support@alien.org.
15. Disclaimers
The following legal disclaimers are required and appear in all caps for legal enforceability. In plain language: the App is provided as-is, and Alien cannot guarantee it will always work perfectly or be available when needed.
THE APP AND ALL RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ALIEN AND ITS AFFILIATES DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, QUIET ENJOYMENT, AND ACCURACY. ALIEN MAKES NO REPRESENTATIONS REGARDING APP COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY.
ALIEN DOES NOT WARRANT THAT THE APP WILL OPERATE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE APP IS FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME ALL RISKS ASSOCIATED WITH APP USE AND ANY DIGITAL ASSETS.
SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF IMPLIED WARRANTIES, SO THESE EXCLUSIONS MAY NOT APPLY TO YOU.
16. Limitation of Liability
The following limitations on liability are also legally required and appear in all caps. In plain language: Alien is not responsible for indirect damages or losses, and Alien's maximum liability is $25 USD.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
(a) ALIEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, DIGITAL ASSETS, REVENUE, BUSINESS OPPORTUNITIES, OR GOODWILL, WHETHER UNDER CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS INCLUDES LIABILITY FOR:
Unauthorized App access or use
Digital asset losses
Malicious code, viruses, or similar threats (regardless of origin)
Equipment damage or injury
Theft, destruction, or unauthorized access to digital assets or data
(b) ALIEN'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED TWENTY-FIVE U.S. DOLLARS (USD $25.00) OR THE EQUIVALENT IN YOUR LOCAL CURRENCY.
(c) NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR OTHER LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
THE FOREGOING LIMITATIONS DO NOT APPLY TO LOSSES CAUSED BY ALIEN'S WILLFUL MISCONDUCT OR GROSS NEGLIGENCE.
17. Indemnification
You agree to defend, indemnify, and hold harmless Alien, its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your violation of these Terms; (b) your use of the App; (c) your violation of any rights of third parties; or (d) any content you submit through the App.
18. General Provisions
18.1 Waiver
Alien's failure to enforce any provision does not waive its right to enforce that or any other provision subsequently. Waivers must be in writing and signed. No single or partial exercise of any right precludes further exercise of that right or any other right.
18.2 Severability
If any provision is deemed invalid, illegal, or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and all other provisions shall remain in full effect.
18.3 Assignment
You may not assign or transfer these Terms or any rights hereunder. Alien may assign these Terms without restriction.
18.4 Interpretation
Section headings are for convenience only and do not affect interpretation. "Including" means "including without limitation." Singular includes plural and vice versa. References to "these Terms" include all incorporated documents.
18.5 Entire Agreement
These Terms, together with the Privacy Policy and any other policies incorporated by reference, constitute the complete agreement between you and Alien regarding the App, superseding all prior agreements, communications, and understandings, whether written or oral.
